Two More States Legalize Hemp Setting Foundation to Nullify Federal Prohibition in Practice

Lost in the shuffle on Election Day, voters in two states legalized industrial hemp, setting the foundation to further nullify federal prohibition in practice.

Provisions authorizing the cultivation of industrial hemp were included in the voter initiatives legalizing marijuana in California and Massachusetts.

The new Massachusetts law prohibits any state interference with hemp production in the state.

Notwithstanding any general or special law to the contrary, except as otherwise provided in this chapter, a person 21 years of age or older shall not be arrested, prosecuted, penalized, sanctioned or disqualified and is not subject to seizure or forfeiture of assets for possessing, producing, processing, manufacturing, purchasing, obtaining, selling or otherwise transferring or delivering hemp.

The new law does not require any license to grow hemp, and it creates no state regulatory structure. This will have a similar effect as a bill passed in Connecticut last year removing hemp from the state’s list of controlled substances. In short, the state will treat industrial hemp like other plants, such as tomatoes. By ending state prohibition, residents of Massachusetts have an open door to start industrial farming should they be willing to risk violating the ongoing federal prohibition.

Provisions in California’s Prop 64 allow the cultivation of industrial hemp as an agricultural product for agricultural or academic purposes. The law also creates a structure to regulate hemp production in the state. The California law does not require growers to get federal permission to cultivate hemp in the state.


Early in 2014, President Barack Obama signed a new farm bill into law, which included a provision allowing a handful of states to begin limited research programs growing hemp. The “hemp amendment”

…allows State Agriculture Departments, colleges and universities to grow hemp, defined as the non-drug oil-seed and fiber varieties of Cannabis, for academic or agricultural research purposes, but it applies only to states where industrial hemp farming is already legal under state law.

In short, current federal law authorizes the farming of hemp – by research institutions only, for research only. Farming for commercial purposes by individuals and businesses remains prohibited. The new California and Massachusetts laws ignore federal prohibition and authorize commercial farming and production anyway.


By rejecting any need for federal approval, state legalization of hemp sets the stage to nullify the federal hemp ban in practice. California and Massachusetts join with other states – including Colorado, Oregon, Maine, Vermont and others – that have simply ignored federal prohibition and legalized industrial hemp production within their state borders.

While prospective hemp growers would still have to take federal law into consideration, by eliminating the state requirement for federal permission, the Rhode Island law would clear away a major obstacle to widespread commercial hemp farming within the borders of the state.

Farmers in SE Colorado started harvesting the plant in 2013, and farmers in Vermont began harvesting in 2014, effectively nullifying federal restrictions on such agricultural activities. On Feb. 2 of 2015, the Oregon hemp industry officially opened for business and one week later, the first license went to a small non-profit group. As more people engage in hemp production and the market grows within these states, more people will become emboldened creating an exponential wave, ultimately nullifying the federal ban in effect.


According to a 2005 Congressional Research Service report, the U.S. is the only developed nation that hasn’t developed an industrial hemp crop for economic purposes.

Experts suggest that the U.S. market for hemp is around $600 million per year. They count as many as 25,000 uses for industrial hemp, including food, cosmetics, plastics and bio-fuel. The U.S. is currently the world’s #1 importer of hemp fiber for various products, with China and Canada acting as the top two exporters in the world.

During World War II, the United States military relied heavily on hemp products, which resulted in the famous campaign and government-produced film, Hemp for Victory!.

This new laws in California and Massachusetts represent an essential first step toward hemp freedom in these states.

 Hemp Can Make America Great Again!

The good news is we’ve found a plant that can save the world. The bad news is…it’s illegal!

Donald Trump has promised to “Make America Great Again”. President-Elect Trump issued his plan for the first 100 days of his administration which includes repeal of Obamacare and the restoration of our economy. However, his plan is missing the most important step that Trump as a businessman can take to jumpstart our economy and provide the best healthcare — quickly and easily.

Many Libertarians see Trump as “Ron Paul lite”. When Dr. Paul ran for the presidency in 2012, he issued his Plan to Restore America which included repeal of the War on Drugs. In 2011, Congressman Paul had introduced bills to legalize industrial and medical hemp. Unfortunately Obama failed to follow suit.

Jack Herer, co-author of the ground-breaking book The Emperor Wears No Clothes: The Authoritative Historical Record of Cannabis and the Conspiracy Against Marijuana said, “I don’t know if hemp’s gonna save the world, but I’ll tell you this… it’s the only thing that can”.

Industrial Hemp: Trillion-Dollar Crop

Our Founding Fathers required farmers to grow hemp because it is so beneficial. Henry Ford created  hemp cars powered by hemp ethanol. Hemp is still used in American cars, but now America has to buy hemp from China, England, Canada, and France because American farmers have not been allowed to grow hemp since misguided policies banned it in 1937. That increases costs 10-15% or more. The US is the largest importer of industrial hemp – and China is the largest exporter!

Ralph Nader pleaded in 2011 “Let Our Farmers Grow Hemp” and said in 2013 “Legalize Hemp – It’s Long Overdue“. It’s time for America to re-affirm hemp as a national treasure, key to our future. In the 2016 Legatum Prosperity Index, America is in 17th place, down from 12th in 2012 and 6th in 2008. The US is the only industrialized country with no hemp industry. In his opposition to the legalization of industrial and medical hemp, Obama has been out of line with our best interests, American history, and the will of the American people.  We can literally no longer afford to ignore hemp, a trillion-dollar crop!

Trump should quickly rescue this vital crop in the first 100 days of his administration. Legalization of industrial and medical hemp could be the Tipping Point that allows us to avoid the escalating financial, environmental, healthcare, and food crises. Hemp can catapult America into an upward spiral!

The benefits of industrial hemp include:

  • Cars: 10 times stronger (safer) and 3 times lighter (more fuel efficient) than steel
  • Cars: Hemp cars are also biodegradable – saving our landfills
  • Cars: Hemp cars have zero tailpipe emissions – protecting our air quality and health
  • Plastics: Replaces 6,000 products made from petroleum– saving our oceans
  • Homes: 50% cheaper to heat/cool, healthier, negative carbon footprint
  • Free of Toxins: Unlike cotton, does not need herbicides, fungicides, or pesticides to grow
  • Clothes: More comfortable, warmer in winter, cooler in summer, durable
  • Paper: 4x as much pulp as from trees, better quality paper – protecting our forests
  • Foods/Drinks: Mega-nutrition, superfood

In 1942, the US government distributed 400,000 pounds of hemp seeds to American farmers to aid the war effort! The Bible and the US Constitution were printed on hemp paper because it does not yellow. Hemp seeds provide the right balance of Omega 3-Omega 6 Essential Fatty Acids to help correct the American diet which has an excess of Omega 6. Hemp is used in over 30 countries and has numerous environmental benefits, including: less reliance on oil, more efficient use of energy, forest conservation, soil redemption and landfill use reduction. Medical Hemp: Panacea


Most bankruptcies are due to medical costs – even for insured Americans. Medical hemp can help keep Americans healthy while quickly and inexpensively reversing a wide variety of degenerative diseases crippling and killing millions of Americans each year. Legalization of medical hemp is now supported by the majority of Americans as a growing number of states make it available. The medical community is also quickly coming onboard. Medical hemp treats over 100 diseases and ailments.

In 2014, Dr. Sanjay Gupta, CNN’s chief medical officer, did a public reversal of his opposition to medical hemp after investigating its curative powers – as shown in the video: Dr. Sanjay Gupta: ‘Why I Changed My Mind On Weed’ – YouTube. The article 89 Percent of U.S. Voters Say Medical Marijuana Should Be Legal shows strong support for medical hemp as calls to end the War on Drugs escalate. Law Enforcement Against Prohibition (LEAP), an international organization of criminal justice professionals, calls for an end to the War on Drugs. The Executive VP of LEAP describes the War on Drugs as “Public Enemy #1”.

The article And the Winner of the 2016 Election Is … CANNABIS! says: “As scientific evidence shows marijuana has beneficial medical effects, the country is becoming warmer to the idea of effectively nullifying the federal rules on the plant. And if 2016 is, indeed, “a tipping point for marijuana reform,” as a spokesperson for the Marijuana Policy Project (MPP) said in an interview, 2017 could see residents in at least three more states passing similar rules.


Trump has the opportunity to begin his administration with a dramatic policy that will unite the sharply divided country. Many Black Americans (and other non-Whites) see Trump’s promise to “Make America Great Again” as a coded message to “Make America White Again”. The presidential campaign was so contentious that the threat of violence still looms over the nation.

So, Trump needs to quickly signal that he plans to serve as president for all Americans. The War on Drugs has imprisoned more Blacks than were enslaved during the 19th century. The law has been harshly imposed in Black communities while White students on college campuses are unaffected.  Ending the War on Drugs will benefit everyone so that Trump will quickly earn the support of the whole nation and encourage all Americans to work together to make America great again.
