Economic theory teaches that free price and profit movements ensure that capitalism produces the greatest welfare for the greatest number. Losses indicate economic activities where costs exceed the value of production, thus investment in these activities is curtailed. Profits indicate economic activities where the value of output exceeds its cost, thus investment increases. Prices indicate the relative scarcity and value of inputs and outputs, thus serving to organize production most efficiently.

This theory doesn’t work when the US government socializes cost and privatizes profits as it has been doing with the Federal Reserve’s support of “banks too big to fail” and when a handful of financial institutions have concentrated much economic activity. Subsidized “private” banks are no different from the former publicly subsidized socialized industries of Great Britain, France, Italy, and the former communist countries. The banks have imposed the costs of their incompetence, greed, and corruption on taxpayers. Indeed, the socialized firms in England and France were more efficiently run and never threatened the national economies, much less the entire world, with ruin as do the private US “too big to fail banks.” The English, French, and communists never had to print $1,000 billion dollars annually to save a handful of corrupt and incompetent financial enterprises.

This only happens in “free market capitalism” where the capitalists, with the approval of the corrupt US Supreme Court can purchase the government, which represents them and not the electorate. Thus, the taxation and money creation powers of government are used to support a few financial institutions at the expense of the rest of the country. This is what is meant by “markets are self-regulating.”

Several years ago Ralph Gomery warned me that the damage done to US labor by jobs offshoring was about to be superseded by robotics. Gomery told me that the ownership of the technology patents is highly concentrated and that breakthroughs have made robots increasingly human in their capabilities. Consequently, the prospect for employment of humans is dismal.

Gomory’s words reverberated with me when I read RT’s February 15, 2014, report that computer and robotic experts at Harvard have constructed mobile machines programmed with the logic of termites to be self-organizing and able to complete complex tasks without central direction or oversight.http://rt.com/news/self-organizing-termite-robots-172/

RT doesn’t understand the implications. Instead of raising a red flag, RT gushes: “The possibilities are vast. The machines can be made to build any three-dimensional structure on their own and with minimal instruction. But what is truly staggering is their ability to adapt to their work environment and to each other; to calculate losses, reorganize efforts and make adjustments. It is already clear that the development will do wonders for humanity in space, hard-to-reach places and other difficult situations.”

The way the world is organized under a few powerful and immensely greedy private interests, the technology will do nothing for humanity. The technology means that humans will no longer be needed in the work force and that emotionless robotic armies will take the place of human armies and have no compunction about destroying the humans on whom they are unleashed. The picture that emerges is more threatening than Alex Jones’ predictions. Faced with little demand for human labor, little wonder thinkers predict that the rich intend to annihilate the human race and live in an un-crowded environment served by their robots. If this story has not been written as science fiction, someone should get on the job before it becomes ordinary reality.

The Harvard scientists are proud of their achievement, as no doubt most of the Manhattan Project participants were about their achievement in producing a nuclear weapon. But the success of the Manhattan Project scientists was not very nice for the residents of Hiroshima and Nagasaki, and the prospect of nuclear war continues to cast a dark shadow over the world.

The Harvard technology will prove to be an enemy of the human race.

This outcome does not have to be, but free market ideologues think that any planning or foresight is an interference with the market, which always knows best (thus, the current financial and economic crisis). Free market ideology stands in the way of societal control and serves the short-term interests of powerful and greedy private groups. Instead of being used for humanity, the technology will be used for the profits of a handful.

That is the intention but what is the reality? How can there be a consumer economy if there is no employment? There cannot be, which is what we are gradually learning from the off-shoring of American jobs by global corporations. For a limited period, an economy can continue to function on the basis of part-time jobs, drawing down savings, food stamps, and extended unemployment benefits.

However, when savings are drawn down, when the heartless politicians who demonize the poor cut food stamps and unemployment benefits, the economy ceases to provide a market for the off-shored goods that the corporations bring home to sell.

Here we see the total failure of Adam Smith’s invisible hand. Each corporation in pursuit of greater managerial “performance bonuses” as determined by profits did its part in producing the destruction of the US consumer market and greater misery for all.

Adam Smithian economics applies to economies in which capitalists have some sense of commonality with other citizens of the country like Henry Ford did, some sense of belonging to a country or to a community. Globalism destroys this sense. Capitalism has evolved to the point where the most powerful economic interests, interests that control the government itself, have no sense of obligation to the country in which their business entities are registered. Except for nuclear weapons, international capitalism is the greatest threat humanity has ever faced.

International capitalism has raised greed to a determinant force in world history. Unregulated greed-driven capitalism is destroying the jobs prospects of First World labor and the ability of Third World countries, whose agricultures have been turned into export monocultures serving the global capitalists, to feed themselves. When the crunch comes, the capitalists will let the “other” humanity starve.

As the capitalists declare in their high level meetings, “there are too many people in the world.”

I can just hear it now. Some educated idiot is going to claim that the global Capitalist are going to make enough profit to feed everyone, so we will not have to do menial work our whole lives. Too that brain fart I say, in your dreams stupid. But wait! There is hope, all we have to do is educate the masses and their self preservation will kick in and then, they will wipe out all the globalist and restore jobs for everyone. Not in your wildest nightmares Henry. The globalist will have you wiped out before you can get your clothes on. Such is human nature, which we seem to be stuck with. America Democracy or Republic?

In my last article, I referenced Ward W. Keesecker on “Democracy” played which prompted this question from a reader: Utilizing this quote would indicate that you were opposed to Democracy; and if so what would you propose as an alternative? The reasoning behind using Keesecker’s comment was that there are differences between a “Democracy” and a “Republic” without actual saying it; because, my next article was going to be a discussion on this very topic.

My response to this question would be: No, I am not opposed to “democracy” or proposing another form of government. Understanding the difference between these two forms of government and how moving from one form to the other is essential to comprehending the fundamentals involved, how it changed and what is at stake for our Republic.

Our Founding Fathers wanted a limited government where no single interest would dominate another leading to the simplistic expression – “majority rule” with “minority rights.” Democracy and Republic are not only dissimilar but antithetical. Distinct contrast exists between an “unlimited” majority in a Democracy, lacking any legal safeguard for the rights of individuals and the minority and a “limited” majority in a Republic with a Constitution that safeguards the rights of an individual and the minority.

In a Republic, the Presidency represents the “monarchial” aspects of our government; the Senate represents the aristocracy/land owners and the House embodies the people. The Senate, even though it represents the aristocracy; were also to represent the “state’s” interest as a corporate entity and the people. The Senate was also designed to be the “guardian of the Constitution;” with checks and balances over the House as well as the President.

Woodrow Wilson, in Division and Reunion 1829–1889 (1893), wrote that “The Federal government was not by intention a democratic government. In plan and in structure it had been meant to check the sweep and power of popular majorities.” By asserting democratic rights and principles could actually paralyze constitutional procedures and processes; so when the system becomes corrupt the whole process ceases to function as intended – a Republic. Chapter on “Constitutionality of the 1st ‘Bank of the United States” is very interesting.

The main distinguishing component of a Democracy is: rule by an all-powerful, “unlimited” majority. Key word here is – “unlimited.” Individuals or any group of individuals composing any minority have no protection against the “unlimited” power of a radical ideological driven majority. Our Founding Fathers condemned “excesses of democracy” and abuses under any Democracy of the unalienable rights of individuals and the majority. Think about it – we currently have legislation that favors special interest groups over or to the detriment of others and an executive branch attempting to suppress the opposition is inherently dangerous. You appeal to a group of individuals who have a “sense of entitlement,” in the name of “social justice,” ends up creating “takers instead of makers.”

“We the people” means, the electorate, not an elite group or an all-powerful “unlimited mob-ruling” majority be it a political party, conglomerates and/or unions. The Constitution was designed to preclude the existence of any governmental power capable of being misused so as to violate the individual’s rights or endangering the liberties of all its citizens.

Bella Dodd, an ex-Communist, described her experience working with communists and their goal to destroy our country by undermining our basic religious and moral foundations including natural law. The Council on Foreign Relations Council as well as elitists such as the Rockefellers, Rothschilds, Goldman, Sachs, and others have undermined our Constitution, sovereignty and promoting a New World Order since the late 1800’s. Note the number of individuals appointed to top positions in this and previous administrations – most are members of the Council on Foreign Relations.

During the late 1800’s and early 1900’s, term “democracy” was used in political speeches and debates relentlessly by politicians, “socialists” and communists for a reason. Note changes to the Constitution: 16th Amendment established the “income tax” and the 17th Amendment altered the manner in which “Senators were appointed.” Both occurred in 1913. In her book, Dodd stated that one goal was to influence legislation and policy – “work to change laws in your (their) favor.”

Garth Jowett implied“Use of the term itself is a systematic attempt to shape perceptions, manipulate cognitions, and direct behavior to achieve the desired response thus achieving the desired intent.”

Noam Chomsky theorized: “The 20th century has been characterized by three developments of great political importance: the growth of democracy, the growth of corporate power, and the growth of corporate propaganda as a means of protecting corporate power against democracy.

If you dismantle the manner in which Senate representatives are appointed, you fundamentally change the character of our government. The 17th Amendment altered the original intent of the Constitution and undermined the “checks and balances” thus achieving one mechanism of change – a “republic” to a “democracy.” Giving Congress the authority to levy an income tax was another mechanism used to expand and increase the size of our government. Both were controversial; but in the end were ratified. Achieving defined and desired goals require “slow meticulous and methodical steps.”

When the people are excluded from the legislative process like Obamacare; or any branch alters existing separation of powers or accumulates too much power toward its own favor dispensing with the legislative process (checks/balances – nuclear option); then any and/or all will destroy a Republic, the very form of government created to safeguard its citizens from this type of abuse.

Ross Way Behind The Curve

A week or so I was explaining to a friend at work how currency is introduced into our economy by the FED. After I finished he said, “Damn Neal, what the hell are you doing here dumping fruit, you are too smart for this shit.” While this isn’t the first time that someone has told me that I’m really smart, the problem is that what good does all this knowledge do me when I can’t get people to think about any of it?

Contrary to what people say, I really don’t consider myself that smart. As Alexander Hamilton once said, “Men give me credit for some genius. All the genius I have is this. When I have a subject in mind. I study it profoundly. Day and night it is before me. My mind becomes pervaded with it… the effort which I have made is what people are pleased to call the fruit of genius. It is the fruit of labor and thought.”

It all depends upon what a person is interested in. I can’t invent new life-saving technologies nor can I compose a symphony, yet I can understand the writings and thought process of the people who established our Republic. I read, and re-read, and RE-READ again the writings of our Founding Fathers, and the men who influenced them, and I then compare what they said to what I see in our country today and I am absolutely amazed that anyone in this country can say that our country even comes close to resembling what our Founders had envisioned.

I don’t know who Joseph Sobran is but I saw a graphic on the internet awhile ago of something he said that has stuck with me. It stated, “In 100 years we have gone from teaching Latin and Greek in high school to teaching Remedial English in college.” But it’s not just language skills that our children our deficient in, it is a sense of national self, an understanding of the history and the political system of the country they live in that our children are lacking. Noah Webster, whose name is synonymous with Webster’s Dictionary, once said, “Every child in America should be acquainted with his own country. He should read books that furnish him with ideas that will be useful to him in life and practice. As soon as he opens his lips, he should rehearse the history of his own country.”

You tell me, can our children do that? Can our adults? Can you? Ask anyone, ask yourself to recite the opening of the Declaration of Independence from memory, or the Preamble to the Constitution for that matter. Ask anyone how many amendments comprise the Bill of Rights and what rights they protect. Chances are they will ignore you, or say, “How the hell should I know?”

Yet when a people, as an entity, do not know how their nation was founded, or the principles upon which their system of government was established, it is an easy task for those in power to usurp powers which it was never intended they possess. Although it has been falsely attributed to Thomas Jefferson, the following quote is nonetheless true, “A government big enough to give you everything you want, is a government big enough to take away everything that you have.”

If you, and by you I mean the people of this country, do not know the limits our Founders imposed upon those who we would elect to represent us, who is to stop them from assuming powers it was intended they do not exercise, or to halt the erosion of your rights for which the government was created to protect?

You look at what happens in this country today when people like Ron Paul talk about a constitutionally limited government, or when groups such as the Tea Party speak out against the abuses of power by the government; they are ridiculed, denigrated, and shunned by the two main political parties in this country. Why is it that a nation that supposedly prides itself on freedom of speech and open-mindedness, shuns any discussion of a government which clearly has violated the limits imposed upon it by the Constitution? Just look at what happened to Edward Snowden when he risked everything to bring to your attention the extent to which your government is spying on the public.

The reason he had to flee for his own safety is because evil does not like having the spotlight shone upon it. Too many people still think they have a choice in the November elections to choose someone who will represent them, be it a governor, a Senator, or a President. We are given two choices, sometimes more, but most always they are Republican or Democrat and they are basically vying for their turn to impose their vision of an all powerful government upon the people.

You may tell yourself that there is a difference between the two parties and that we have to elect the lesser of the two evils if we wish to halt the decline of our nation. But if we choose a lesser evil, aren’t we still getting evil? If you want to know who runs this country you need to follow the money. I’m not talking about who contributes to the campaigns of those running for office, I’m talking about those who finance the party machines behind them. I’m talking about who funds the Republican and the Democrat parties. They are the machines that generate the candidates we choose from, and they will not fund, or support, anyone who strays from their respective platforms. Just look at how the Republican Party shunned Ron Paul, even though he was running as a GOP candidate for president. I have my own questions about Ron Paul, but if you REALLY wanted a lesser of two evils for president, he was the one you SHOULD HAVE voted for.

But we have become such obedient little sheeple that we follow orders and believe everything we are told by the supposed pundits and experts, it has gotten so bad that we are damn near incapable of forming an intelligent thought of our own. How else can you explain why so many people go about their lives uncaring that their rights are slowly being eradicated and that our country is moving closer and closer to a complete police state?

Just look at how many, quote unquote, law ENFORCEMENT agencies the government has at its disposal to keep YOU in line. Yet where is the law enforcement to keep our government in line with the Constitution? Answer me that Batman. You violate any of the laws our government enacts and some agency is tasked with ensuring that you are fined, arrested, or imprisoned for your offense. Yet can we the people fine, arrest, or imprison those who swear an oath to uphold the Constitution? I dare you, no, I double dare you to walk into your representatives office and place them under citizen’s arrest for violating their oath. Just watch what happens to YOU.

No folks, we live in a police state where the real criminals are in charge and there is not much you can do about it as long as you continue to believe that we have a free democratic process. And believe me, the criminals have been busy just in case one day the people of this country do wake up to their treason or if by their mismanagement of affairs our country suffers a catastrophic economic collapse.

Most people shake their heads in disbelief when someone mentions the things I am about to say, but facts are facts and you are a fool if you expect the government to come out and confirm the things I am going to say. But as a lover of liberty I cannot, in clear conscience, not try to warn you.

The government has camps, some call them FEMA Camps, some call them relocation centers, but they are basically prisons. They are all over the country and they are designed for one thing only, to confine large numbers of people in the event things get out of hand in America. If people such as myself, those who try to warn people about the abuses of power by their government, are not initially exterminated, we will be housed there. So will those who are non-productive members of society. So those of you who are as happy as a pig in a shit right now due to all those benefits you get from Uncle Sam at no cost, you may one day find yourself in one of these facilities.

Just look back through your history when any system of government becomes totalitarian…what happens to those who dissent or serve no useful purpose? Look to Nazi Germany and the SS, or Soviet era Russia with the KGB and their gulags. Think that can’t, or won’t, happen in America? Keep dreaming.

Just look at the Department of Homeland Security. Why in the world do they need all those armored vehicles they have, or the millions of rounds of ammo they have been purchasing? Now I’m hearing that they are planning to purchase 141,000 rounds of sniper ammunition. Are they expecting a war, and if so, against whom? Call me crazy but I think they are expecting something, be it enough of the people waking up to their governments crimes, or a social upheaval do to an economic collapse. Whatever the case they are gearing up for something, and most people today are completely oblivious to it.

Then there are all the Executive Orders that have been in place, some of them dating back to when JFK was president. There is EO 10995, which allows the government to seize control of the media. Why would they want to do that unless it was to halt the flow of information to the people? But that’s not all.

There is EO 10999, which allows the government to take over all modes of transportation and control of highways and seaports; there is EO 10997, which allows government to take over control of all electrical power, gas, fuels and minerals; there is EO 10998, which allows government to take over all food resources and farms; and finally EO 10000, which allows the government to mobilize civilians into work brigades under supervision of federal agents. It even allows for the breaking up of families if it is deemed in the public’s best interest. Why would they issue Executive Orders such as these if they never intend to use them?

But no, we don’t live in a police state say the sheeple. Maybe, at least for now we don’t, not to the degree I am talking about. But the infrastructure is in place and all they need is the right crisis for them to suspend the Constitution and the Bill of Rights, impose martial law, and then what are you going to do?

You tell me, with all this spying our government is doing; with all those drones, not only capable of spying, but firing upon you, flying around; with all that ammo being purchased and all those armored vehicles being purchased by DHS and even local law enforcement, aren’t you just a BIT CONCERNED? Or is what’s on prime time tonight more important?

Sorry people, you’ve been brainwashed into following orders, to obeying anyone in a position of authority, and to NOT question anything. The terms serve and protect no longer have any meaning for those whose job it is to enforce the law. They are here to KEEP YOU IN LINE. The moment you question their authority, or the legality of what they are doing, you are tazed, pepper sprayed, beaten into submission, or even shot and killed. In the America of 2014 there is no room for civil disobedience.

Like I said, America is way behind the curve. The average person still thinks this is the land of the free and the home of the brave. Well, if your among those that do, I ask that you try questioning authority, try disobeying some law you find to be unconstitutional. You’ll quickly find out how free you are, that is if you are even brave enough to attempt it.

Government Lays Groundwork To Confiscate Your 401k and IRA: “This Is Happening”

This morning Reuters obtained a leaked proposal disclosing that European Union officials are looking for new and innovative ways to fund their immense debt levels. As noted by Zero Hedge, they’re no longer turning exclusively to central bankers to simply print more money as needed.
Because last year’s bank bail-in forcing the confiscation of funds from average depositors in Cyprus worked so well, EU regulators and bankers have determined that they’ll use a similar method to fund their future endeavors.

In a nutshell, and in Reuters’ own words, “the savings of the European Union’s 500 million citizens could be used to fund long-term investments to boost the economy and help plug the gap left by banks since the financial crisis, an EU document says.”

The solution? “The Commission will ask the bloc’s insurance watchdog in the second half of this year for advice on a possible draft law “to mobilize more personal pension savings for long-term financing”, the document said.”

Mobilize, once again, is a more palatable word than, say, confiscate.

This is what happens when governments run out of money.

But if you think this is limited to just Europe, then consider the words of President Barack Obama in his recent State of the Union address.

For all intents and purposes, a similar groundwork is being laid right here in America.

They’ve already taken over the health care industry… why not nationalize our retirement savings while they’re at it?

This is basically the offer that the President of the United States floated last night.

And like an unctuously over eager used car salesman, he actually pitched Americans on loaning their retirement savings to the US government with a straight face, guaranteeing “a decent return with no risk of losing what you put in . . .”

This is his new “MyRA” program. And the aim is simple– dupe unwitting Americans to plow their retirement savings into the US government’s shrinking coffers.

We’ve been talking about this for years. I have personally written since 2009 that the US government would one day push US citizens into the ‘safety and security’ of US Treasuries.

Back in 2009, almost everyone else thought I was nuts for even suggesting something so sacrilegious about the US government and financial system.

But the day has arrived. And POTUS stated almost VERBATIM what I have been writing for years.

The government is flat broke. Even by their own assessment, the US government’s “net worth” is NEGATIVE 16 trillion. That’s as of the end of 2012 (the 2013 numbers aren’t out yet). But the trend is actually worsening.

In 2009, the government’s net worth was negative $11.45 trillion. By 2010, it had dropped to minus $13.47 trillion. By 2011, minus $14.78 trillion. And by 2012, minus $16.1 trillion.

Here’s the thing: according to the IRS, there is well over $5 trillion in US individual retirement accounts. For a government as bankrupt as Uncle Sam is, $5 trillion is irresistible.

They need that money. They need YOUR money. And this MyRA program is the critical first step to corralling your hard earned retirement funds.

At our event here in Chile last year, Jim Rogers nailed this right on the head when he and Ron Paul told our audience that the government would try to take your retirement funds:

I don’t know how much more clear I can be: this is happening. This is exactly what bankrupt governments do. And it’s time to give serious, serious consideration to shipping your retirement funds overseas before they take yours.

As former Congressman Ron Paul notes, the government will stop at nothing.

“They’ll use force and they’ll use intimidation and they’ll use guns, because you can’t challenge the State and you can’t challenge the State’s so-called right to control the money,” warns Paul. “It’s already indicated that they will confiscate funds and they will [confiscate] pension funds.”

This didn’t just happen over night. The move to make this reality has been going on for quite some time. The first time it was mentioned publicly in any official capacity was at a 2010 Congressional hearing:

Democrats in the Senate on Thursday held a recess hearing covering a taxpayer bailout of union pensions and a plan to seize private 401(k) plans to more “fairly” distribute taxpayer-funded pensions to everyone.

In a nutshell, under the GRA system government would seize private 401(k) accounts, setting up an additional 5% mandatory payroll tax to dole out a “fair” pension to everyone using that confiscated money coupled with the mandated contributions.  This would, of course, be a sister government ponzi scheme working in tandem with Social Security, the primary purpose being to give big government politicians additional taxpayer funds to raid to pay for their out-of-control spending.

You’d think that such an idea would be immediately dismissed by the American public, but it has only gained steam since, as evidenced by a 2012 hearing held at the U.S. Labor Department:

The hearing, held in the Labor Department’s main auditorium, was monitored by NSC staff and featured a line up of left-wing activists including one representative of the AFL-CIO who advocated for more government regulation over private retirement accounts and even the establishment of government-sponsored annuities that would take the place of 401k plans.

“This hearing was set up to explore why Americans are not saving as much for their retirement as they could,” explains National Seniors Council National Director Robert Crone, “However, it is clear that this is the first step towards a government takeover.

It feels just like the beginning of the debate over health care and we all know how that ended up.

Such “reforms” would effectively end private retirement accounts in America, Crone warns.

A few years ago the government of the United States of America nationalized nearly 1/6th of our economy when they took over the health care system with forced mandates. In the process they essentially took control of $1.6 trillion in yearly industry revenues.

But that’s nothing compared to private savings. The total amount of retirement assets in America, including 401k, IRA and savings accounts is around $21 trillion. With our national debt coincidentally approaching the same, the government sees big money and potentially a way out of our country’s fiscal disaster.

This will start voluntarily with the MyRA and other state-sponsored programs. But when not enough Americans are making it their patriotic duty to turn over their funds to their government, they’ll mandate compliance with the stroke of a pen just as they did with the Patient Affordable Care Act.

And just like Obamacare it will be enforced by the barrel of a gun. Failure to comply will mean confiscation without recourse and prison time.

All they need now is a trigger.

And that trigger will likely come in the form of another stock market collapse. Wipe out Americans’ in a stock market crash and scare the heck out of them with more economic bad news, and millions of our countrymen will be all too willing to hand it over to Uncle Sam. Panic is a powerful motivator and what better way to get people on board than by threatening them with squalor and destitution in their old age if they don’t go along with it?

Government officials have been actively working to make this a reality for years. The Europeans are doing the same.

You can put your head in the sand or cover your ears and pretend this is not happening, but that won’t change the outcome.

They will take everything they can get their hands on.

Non-Participation And Decentralization As Primers For Revolution

When writing investigative examinations on the corrupt state of American government and American economy, invariably one is met with the same set of ever cycling broken-record questions and assertions. One of the primary responses I have received and I’m sure most Liberty Movement analysts have received is this:

Okay, now we know what the problem is, but when are YOU going to tell US what the solution is…?

The question seems “reasonable”, but in reality, everything that is weak minded in our culture today is summed up in its content.

First, the question insinuates that there is no utility in exploring the nature of a crisis without “fixing” the situation right then and there. Often, the most complex problems of our world require years if not decades of thought and action, trial and error, before a single working solution is generated. When the problem involves a criminal government run by corporatist oligarchs bent on total globalization and centralized control of finance, society, and law, you have to expect that there will be some difficulties in finding a remedy. You will never defeat your enemy without knowing your enemy, and our particular fight requires endless analysis.

Second, I wish I could convey the palm-to-forehead agony I feel every time I hear someone begging for myself, or anyone for that matter, to overnight mail them a solution on a silver platter wrapped in perfect little pink bow. Why is it that so many Americans today refuse to offer THEIR OWN solutions to the problems they perceive in the world? Is it laziness, or stupidity, or both? They are so busy waiting for a “white knight” to come and save them they have forgotten to learn how to save themselves. Don’t sit idle expecting analysts to make your life better. Become industrious. Take initiative. Think of something we haven’t thought of yet. Stop being followers and start becoming leaders within your own communities.

Third, the worst of all dilemmas when dealing with the above question is that most of the time, it is being asked by people who already have a preconceived answer they want to hear. Many in our movement today want a silver bullet solution. They want magic and fairy dust. They want to end tyranny with a snap of their fingers, the press of the button, within the span of a day, or perhaps a week. They don’t want to have to work beyond their normal capacity, they don’t want to struggle, they don’t want to sacrifice, and they certainly don’t want to risk their property, livelihood, or life.
They want a civil rights style MLK/Gandhi march on Washington D.C., which has already been done over and over again leading to nothing but ever more corruption (you don’t ask tyrants to police themselves, nor do you ask for their permission to change government). They want an armed march on Washington D.C. (perhaps the most tactically moronic strategy ever to be suggested year after year), leading to nothing more than a bloodbath which would only make the Liberty Movement appear weak, or insane, all in a failed attempt to unseat a bunch of politicians who are merely puppets and middle men for the financial elites. They want Generals grandstanding as purveyors of constitutionalism to initiate a military coup to remove the “evil Muslim” from his seat of power (is Obama a Muslim, or an atheist Communist? These methodologies tend to negate each other…), while the truth is, Obama is nothing more that a minor obstacle compared to the greater evil of central banking and internationalism, and a Neo-Con Republican (or provocateur General) could easily continue Obama’s work without missing a beat.

And, most of all, they want something flashy, something new, something technological and glorious to solve all their woes. How many times have you heard the claim, for instance, that digital currencies like Bitcoin would “bring down” the central banks and turn the globalist empire to dust at our feet? Yet, Bitcoin’s very existence relies on the Web, a government dominated networking system which they can remove from our hands any time they wish.
These are not solutions, they are distractions, or worse, con-games. They are designed to fool you into thinking that you can lounge behind your computer, or walk blindly down the street with a sign or a gun, and the nation will attain renaissance without a tear or a drop of blood shed. They are pleasant lies that many people want to have whispered to them.
I have no interest in making people feel comfortable, or safe, or at ease in the nature of the task before us. I’m only interested in the truth, and the truth is, REAL solutions have already been offered to the Liberty Movement. For years we’ve been talking about them, implementing them, and attempting to convince others to implement them. These solutions are not easy. They are not pleasant or quick. They will require much sacrifice, and unimaginable suffering. There is no way around these tasks if we are to succeed and dismantle centralized totalitarianism in our lifetimes…
Non-Participatio 

This is a simple concept that for some reason tends to confound people. If you march to the steps of the White House motivated by a desire to educate others on the hidden dangers of our political situation, then this is all well and good. But, if you march to the steps of the White House with the expectation that this gesture will somehow impress or frighten the military industrial complex into forsaking its criminal ways and step down from power, then you have fallen into a delusional paradigm.

If you are using a government controlled communications medium like the Internet to educate others while the system still exists, then this is practical. But, if you really believe that you are going to exploit that same network as an offensive tool to destroy Big Brother, you are living in techno-geek dreamland.
And, if you still think that the diseased political arena has any merit whatsoever and that the system can be inoculated from the within, or that you can rewrite the rules on a whim (constitutional convention) and have those rules followed, at this point I don’t hold much hope for you.
Now, I want you to imagine, just for a moment, that the government does not exist. The Internet does not exist. Corporate banking chains and department stores and grocery outlets do not exist. State law enforcement organizations do not exist. State run schools do not exist. How would you go about living day to day without the bureaucracy, the welfare, the infrastructure, the safety nets? This is how ALL Liberty Movement activists are going to have to start thinking if they want to change anything.
The Non-Participation Principle is best summarized like this: 
When facing a corrupt system, provide for yourself and your community those necessities that the system cannot or will not. Become independent from establishment-controlled paradigms. If you and your community do this, the system will have one of two choices:

  1. Admit that you do not need them anymore and fade into the fog of history, OR…
  2. Reveal its tyrannical nature in full and attempt to force you back into dependence.
  3. In either case, you win. You have taken proactive measures to remove yourself as a cog in the machine. The machine can then of course try to demonize you, or attack you, but ultimately, they will attack from a place of social and moral weakness, and you will defend from a position of logistical and moral strength.

Stop waiting for the system to change, or collapse. Change the way YOU live and survive. Build your own localized systems and walk away.
Decentralization
Learn a vital trade skill, grow your own food, purchase resource rich raw land, learn self defense methods beyond what law enforcement personnel are trained in (which is not too difficult), take EMT training courses so that you can provide general and emergency medical care for your family, get your children out of the state run common core indoctrination centers and homeschool them, build neighborhood watch groups, emergency response groups, barter markets and alternative economies.
Decentralization is about dissolving our unbalanced relationship with the state and taking away their power to dictate how we live. If a core necessity is centralized in the hands of a select few, then we start producing it ourselves and remove that option from their deck of cards. You cannot fight a corrupt system if you are dependent on a corrupt system.
The very essence of globalism is centralized oversight of every aspect of our lives. When we allow ourselves to feed from the government or corporate trough because it’s “easier”, we are essentially volunteering to be herded like animals. It is within the power of every single individual, no matter their age or financial circumstances, to find creative ways in becoming more independent. It is up to you. There are no excuses.
Revolution
We should have no illusions that the criminal elements of our government will simply shrug their shoulders and give up. When we decentralize, we show the world how irrelevant they are. Tyrants must remain relevant to the masses, otherwise, they have no means to dominate except pure force. When that force is eventually applied, the ONLY logical response is revolution. Decentralization is not a means to “avoid” such revolution, it is only a means to strengthen our position in preparation for revolution.

There is no ideal revolutionary model because the unique nature of one’s epoch determines the nature of one’s rebellion. However, I can say that any revolution that does not focus on the foundational culprits behind the offending tyranny is doomed to failure. When I see the overt obsession with Barack Obama as some kind of linchpin in the development of socialism in America, I have to remind people that Obama has merely stood on the legislative efforts of George W. Bush, and so many other globalist presidents before him, in order to bring the U.S. to the current point of catastrophe. And who made these men, these so-called “leaders”? Who financed their campaigns? Who taught them the internationalist methodologies they now implement? Who really controls money, and thus economy, and thus politics in this country?

Revolution must be directed at the oligarchs, not just their mascots, and if anyone asks you to rally around a revolution that does not name central banking and international banking entities and the men who run them as direct culprits, they are probably controlled opposition. We don’t need a French or Bolshevik Revolution to replace old puppets with new puppets, we need to go to the very heart of the cancer that has stricken our nation and remove it. If this means we have to physically fight back, then so be it, but we must be smart in how we fight.

In the end, the average citizen is his own defender, his own governor, his own industrialist, his own “king maker”. He may consciously realize this, or he may be oblivious. All of the solutions, all of the tools, are right there, in his hands, waiting to be used. The saddest truth of all is that the only thing holding him back from legitimate freedom is his own fear. Only when we stop avoiding the pain required to procure independence, will we finally have it.

I strongly recommend each reader to read his archives at http://alt-market.com/ You can shorten your education considerably by reading everything he has written. How a young man in his early thirties is so intelligent is a mystery to me, but you will find I’m right when you follow is work. The article above should make all who read it stop and think, compare, and analyze what he say’s in relation to what you can plainly see. As much as I would love to organize a group of world class snipers, and take out all of the top International Investment Bankers, and then start in on world leaders of Nations, it is a pipe dream of stupid anger, and completely impossible to organize anything in today’s communication climate. This can only be accomplished in the movies of our super hero’s, who have prayed on our minds like maggots on spoiled food. In truth, the heads of the media industry should be at the top of the list, but that would only send the Bankers into hiding, with army’s of hired killers at their disposal. The enemies of truth, freedom, and justice are highly mobilized, well funded, and efficiently organized.

The institutional structures of power, whether local, national or global, are effective mechanisms through which the ruling groups of society establish and entrench their influence, build consensus among each other, brainwash and expand their control over the masses and society as a whole. Whether they take the form of think tanks, universities, governments, corporations, militaries, intelligence agencies, NGOs, media conglomerates, international organizations, philanthropic foundations, they are institutions of control and conquest.

Whether that conquest is ideological or physical, the effect is the same: the conquered are oppressed and repressed.

These institutions are financed through the global banking system of collusion between the private banks and quasi-governmental central banks, who control the money supply and value of the change in your pocket, which are in fact a highly concentrated group of institutions and individuals. Never in all of human history have so few controlled so much on such a global scale, nor have so many had so little on an equally global scale.

Never before in history have the mechanisms for absolute total global control and oppression been within such close reach. We are seeing the emergence of this ‘new society’ in which governments are increasingly imperialistic abroad and militaristic at home, as domestic police states are established under the guise of ‘homeland security’, sold on the pretense of protecting people from terrorists, but in actuality are designed to protect the powerful from the people.

Increasingly, civil rights and freedoms are being dismantled for the wider populations: countries and peoples all around the world are subjected to bombings, drone attacks from flying killer robots in the sky named “Predators”, and high-tech military equipment is designed and used to more effectively kill and conquer poor people all around the globe.

In the emerging ‘homeland security states’, technology is being used to spy on people, all internet traffic monitored, phones tapped, cameras recording not only our images, but through biometrics they are categorizing and quantifying our specific individual faces and emotional responses. We are, increasingly, seeing the emergence of a hybrid nightmarish scenario of ‘Brave New World’ meets ’1984.’ Technology has largely facilitated the advances in these areas and has, for the first time in all of human history, made possible the notion of a truly global police state.

Yet… there is still hope.

The Technological Revolution has not only facilitated a more rapid and effective apparatus for the institutions of power to exploit in methods of oppression and control, but it has simultaneously facilitated the rapid and effective means through which more people than ever before in human history have access to and empowerment through information and communication on a truly global scale.

As a result of the Internet, the traditional institutions of power have lost their monopoly of control over information and communication.

The very same technological advances that make possible their methods of control and conquest are simultaneously making possible their eventual downfall and failure. While the powerful have the money and are highly centralized, the rest of the world increasingly have the means and remain highly decentralized. And while the powerful are few, the rest are many. The Internet and social media have become effective means through which people are able to empower themselves to struggle against and expose the institutions of power that seek to oppress and control them. Naturally, those same institutions seek to influence – whether overtly or covertly – those very same avenues of social media, they are still effective and available for the struggle for liberation from oppression.

Obamacare herds the poor into Medicaid which requires some patients to forfeit homes or any assets they might have to the state to cover the cost of their medical care. The research article below is meticulous and demonstrates that Obamacare was not enacted to serve the people.

Obamacare: The Final Payment
Raiding the assets of low-income and poor Americans

Since writing “Obamacare: Devils in the Details” posted on this site on February 3, 2013, I have investigated in detail other aspects of the insurance industry’s program to bring health care to Americans. In this article I explain estate recovery to which poorer Americans herded by Obamacare into Medicaid are subject. In violation of moral philosopher John Rawls’ second principle of justice, some of the poorest Americans will pay the highest cost of health care as they, and they alone, are subject to having the family home and any other assets they might possess confiscated by the state in order to reimburse Obamacare for the cost of their medical expenses. The compassionate rhetoric aside, Obamacare makes the poor pay the most.

Under what was deceptively named the Affordable Care Act (ACA), commonly known as Obamacare, which is unaffordable for the patient in more ways than one, beginning January 1, 2014, citizens without health insurance must pay a tax penalty to the Internal Revenue Service (IRS). Qualified individuals and families with incomes between 138 and 400 percent of the Federal Poverty Level (FPL) can shop for commercial insurance policies at a Health Insurance Marketplace (an exchange) and may be eligible for a subsidy from the government to help pay for a plan. Those with incomes at or below 138 percent of the Federal Poverty Level will be tossed into Medicaid unless there are specific reasons why they would not be eligible.

The Federal Poverty Level incomes for different family sizes for 2014 established by the Department of Health and Human Services can be found here: http://aspe.hhs.gov/poverty/14poverty.cfm To determine whether you will be put into Medicaid, find the Federal Poverty Level annual income that applies to your family size for 2014 from the HHS tables and multiply the amount by 1.38. If your annual income is not larger than this amount, into Medicaid you go. For example, to avoid being put into Medicaid by Obamacare, a single individual in the 48 states and D.C. needs an income that is more than 138 percent of $11,670 (more than $16,105). A family of four needs an income that is more than 138 percent of $23,850 (more than $32,913). Poverty level incomes in Alaska and Hawaii are higher due to the higher cost of living in those states.

You won’t find estate recovery in the ACA. It’s in the Omnibus Reconciliation Act of 1993 (OBRA 1993)–a federal statute which applies to Medicaid, and, if you are enrolled in Medicaid, it will apply to you.

Estate Recovery

OBRA 1993 requires all states that receive Medicaid funding to seek recovery from the estates of deceased Medicaid patients for medical services received in a nursing home or other long-term care institution, home- and community-based services and related hospital and prescription drug services regardless of age. It also allows, at state option, recovery for all services used in the Medicaid state plan at age 55 or older. At minimum, states must pursue recovery from the probate estate which includes property that passes to heirs under state probate law, but states can expand the definition of estate to allow recovery from property that bypasses probate. This means states can use procedures for direct recovery from bank accounts and other funds. The state keeps a running tally, and even if you have a will, your heirs are chopped liver. Estate recovery can be exempted or deferred in certain situations after your death, but the regulations for this are limited and complicated with multitudes of conditions.

Your estate is what you own when you die–your home, other real estate in which you have a legal interest, personal property, bank accounts, annuities and so on. For cash-strapped states, recovery provides an income stream, and with the expansion of Medicaid states will be in dire need of money, particularly in the current economy.

You must first understand that if an exchange determines you are eligible for Medicaid, you have no other choice. Code for exchanges specifies that an applicant is not eligible for a subsidized plan to the extent that he or she is eligible for coverage under Medicaid. Therefore, when you apply, if you are found eligible, you will be tossed into Medicaid. You can also be auto-enrolled in Medicaid if you are presumed eligible through a database such as SNAP (food stamps). If you are enrolled in a subsidized private plan through an exchange and your circumstances change making you eligible for Medicaid, in you go.

Obamacare revises Medicaid regulations in order to make more Americans eligible for Medicaid. Revised regulations include an increase in age and income limitations, and the asset test no longer applies. Prior to these revisions, applicants were not eligible for Medicaid if they had more than a specific dollar amount in assets. But, under Obamacare, those who likely own a home or have savings set aside–for example, early retirees or people who have lost their jobs and, as a result, are in a low income bracket–will find themselves in Medicaid, and their assets will be looted by the government when they die for medical services used at age 55 and up.

Estate recovery can have a damaging impact on low-income and poor Americans. It is a pernicious death tax on those who have the least and are the most vulnerable. Often, the only asset they have is the family home and what’s in it, and, for some, this has been the family home for several generations. The threat of losing the home causes people to forego health care.

Home equity is part of a deceased Medicaid recipient’s estate and except under certain circumstances is subject to estate recovery. Surviving family members may either sell the home and use the proceeds to satisfy the Medicaid claim or, if they wish to keep the home in the family, they can satisfy the claim with their own personal funds. This Medicaid clawback not only confiscates family property but also robs people of their dignity as Medicaid allows only an amount it considers reasonable for services provided by a funeral home and burial costs. In some states, funeral homes are responsible for notifying Medicaid if there is excess money in a burial trust fund so it can also be pillaged.

Some might think it fair that those who are enrolled in Medicaid pay back the benefits they received. However, under a mandate that requires all Americans to be covered by health insurance or pay a tax penalty to the IRS, estate recovery is unconscionable since Obamacare offers no other viable option for this income-segment of the population. It also discriminates by age since only Medicaid enrollees who use benefits in the state plan at age 55 and up are subject to estate recovery, but those who use benefits at age 54 or less are home free unless they receive long-term care. Under federal law, discrimination is not permitted on the basis of age, but, obviously, the U.S. government turns a blind eye to to its own law. Perhaps, when states need more money due to the Obamacare expansion of Medicaid, and as the jobless economy continues causing more people to be eligible, age discrimination will be broadened to 45 and up.

You may be eligible for an exemption from having to pay a penalty for being uninsured if you meet specific requirements–for example, if you are in jail, if you have a sincerely-held religious belief that prevents you from seeking and obtaining medical care, if you are eligible for Medicaid under its expansion but live in a state that opted not to expand Medicaid, if you are a member of an Indian tribe, and several other situations. But there is no exemption for people who refuse to sign up for Obamacare because of the Medicaid estate recovery program.

Since the plans at the Obamacare exchanges are income-based, you may be put into Medicaid when you apply for insurance. Or, you may start off enrolled in a subsidized plan, confident that estate recovery won’t apply to you, but several months or a year later, due to a change in your circumstances, find you have been tossed into Medicaid. You can increase your income in order to avoid Medicaid, but it would have to remain over 138 percent of the Federal Poverty Level throughout the taxable year. If paying for insurance will deprive you of food or shelter, you can try filing for a hardship exemption, that is, if the government site is working smoothly, and if you can find the form. It is important to understand how this income-based scheme works so you can figure out how best to survive the many caveats of Obamacare. Estate recovery was not an unintended consequence of Obamacare. The House Ways & Means Committee and The House Energy & Commerce Committee share jurisdiction over health care, including Medicare and Medicaid, and both worked extensively on Obamacare. So, don’t bother thinking that the members of these committees didn’t know that estate recovery would impact millions of Americans who would be tossed into Medicaid. The asset test was dropped and the age limit was increased explicitly in order to expand Medicaid. Yet, did We the People hear any concern about estate recovery? Certainly not in the many floor speeches given by Democrats as well as Republicans or from the media.

Obama stated during his 2008 presidential campaign that transparency would be the leverage needed to ensure that people stay involved in the national health care reform process. The expansion of Medicaid was part of the process. Did Obama or your representatives tell you that Medicaid, depending on your age, is a loan subject to deferred payment by your estate? Did they tell you the government subsidy for a private plan at an exchange is a loan, that must be repaid if your income increases? Transparency was highly selective. The bait was shown but not the hook.

Obama also often made the point that the public should receive the same level of coverage and care as members of Congress. Medicaid is hardly the same level of coverage and care, but, aside from that, tell us, Mr. Obama, because your health care is funded by taxpayers, will your estate be subject to recovery?

The fact that Obamacare did not revise existing federal statute–in other words, it retained estate recovery–most certainly undermines the compassionate rhetoric about helping low-income and poor Americans.

Official Response To Estate Recovery Inquiry

In October 2009 during the national health care reform debacle, eight public-spirited citizens, dismayed as they watched Obamacare morph into deception, signed and faxed a letter to 28 members of Congress, Democrats and Republicans alike, including chairs and ranking members of the various health care policy committees working on Obamacare. The letter addressed “Discrimination, Estate Recovery & Exploitation in National Mandated Health Insurance.” Other recipients included President Barack Obama; Kathleen Sebelius, Secretary of Health and Human Services; and Nancy Ann Deparle, Director of White House Office of Health Reform.

The letter pointed out that absence of choice for Medicaid-eligible citizens other than a costly penalty is discrimination based on economic status. It also stated that the Medicaid estate recovery program discriminates by age and against those who own a home and have other assets versus those who do not. The letter asked if OBRA 1993 had been amended so states would not be allowed to recover assets or place liens on property under national mandated health insurance, and, if there was no amendment, why not?

The citizens who sent the letter received no response from Congress or the Obama administration. The government that comprises ObamaNation, Inc. serves only its money masters.

Depending on their state of residency, Americans can sign up for Obamacare coverage with a federal or with a state exchange. The US Centers for Medicare and Medicaid Services (CMS) is the federal office that established the federal exchange at healthcare.gov at which residents of the 36 states that chose not to use a state exchange can sign up for Obamacare. (New Mexico and Idaho have state exchanges but are currently using the federal one.) Fourteen states and the District of Columbia submitted proposals, which were approved by CMS, to run their own exchanges.

In June 2013 a letter was sent to the Centers for Medicare & Medicaid Services by a well-informed citizen pointing out that the Medicaid Manual prepared by CMS to provide guidance for states contains procedural rules intended to ensure that individuals are informed about estate recovery before they complete the application process.

There are variations in the ways in which states implement estate recovery, depending upon their Medicaid program and state laws. However, Federal law requires all states to incorporate the following protections for Medicaid recipients into the design of their estate recovery program:

— The State should notify Medicaid recipients about the estate recovery program during their initial application for Medicaid eligibility and annual re-determination process.
— The State must notify affected survivors about the initiation of estate recovery and give them an opportunity to claim an exemption based on hardship.
— The State must establish procedures and criteria to waive recovery if it would cause undue hardship.

The letter went on to say that the final CMS Health Insurance Marketplace application (healthcare.gov) notifies applicants about Medicaid’s right to pursue and recover any money from other health insurance, legal settlements or other third parties but does not disclose estate recovery. Since estate recovery is one of the terms of the Medicaid contract, it is deceptive to omit disclosure of this practice. CMS was asked to provide the reasons for this omission.

CMS responded evasively to the concerned citizen’s question. CMS claimed that the Health Insurance Marketplace application at healthcare.gov does not disclose Medicaid’s right to claim against the estate, because CMS wanted to provide flexibility to state Medicaid agencies as to how each one notifies applicants about estate recovery. Some states have developed pamphlets to address common estate recovery questions or devote a portion of a general Medicaid pamphlet to the subject. Some states also post their state plans, perhaps with additional explanatory text, on their web sites.

Even if we take this claim at face value, it reflects a cavalier attitude. As health insurance is mandated with low-income earners and the very poor having no alternative to Medicaid, certainly those subject to estate recovery have a right to be notified in advance of being herded into this insurance plan.

It is well worth knowing about estate recovery before you sign up at an Obamacare exchange so you can make an informed choice as to whether or not you want to get trapped in this Byzantine sinkhole or steer clear, particularly if you think your income may relegate you to coverage under Medicaid now or in the future. Unfortunately, it appears that CMS as well as some of the state-based exchanges, such as Covered California, decided you don’t deserve to know about this particular term of the Medicaid contract when you apply and sign on the dotted line. So, as of this writing, there is no mention of estate recovery on the Obamacare application at healthcare.gov that services residents of the 36 states which use the federal exchange nor for Californians, residents of a state with a robust estate recovery program! Some states disclose estate recovery on their state exchange applications for Obamacare, and others do not.

Non-disclosure of estate recovery on an Obamacare application does not mean that the state in which you reside will not bill your estate for the cost of your medical treatment under Medicaid. It merely means that a conscious choice was made not to let you know that one consequence of signing up for Obamacare could be the loss of your home.

There are a few states that recover for long-term care only. It would be in your best interest to find out your state’s recovery policy so you know where you stand. You should also remain alert to changes.

Here is what you need to know:

When you complete the application at healthcare.gov, it is assumed that when you submit it, you are fully informed and agree to all terms. Submission of the application is akin to signing a contract. Your signature not only means you have provided true answers to all the questions under penalty of perjury, but also that you understand and agree to all the rules and conditions. However, by not disclosing estate recovery CMS expunged your right to make an informed decision. Therefore, you may not realize that your estate can become government property because Obamacare forces you into Medicaid if your income is less than the threshold for a subsidized premium.

When you sign a loan note at a bank, you are agreeing to the terms and conditions of the contract between you and the bank, and these are disclosed in the note. The banker doesn’t say to you, “Just sign here and we’ll let you know the terms later. You can pick up a pamphlet at our local office or request that one be mailed to you. Or, you can visit our website and see if you can find the page that tells you what you just signed yourself into. Thank you. We appreciate your business.”

Even if your circumstances change such that you are no longer eligible for Medicaid and you are shifted into a subsidized Obamacare plan, any Medicaid expenditures you incurred remain as claims on your estate.

According to the federal procedural rules, the state should notify Medicaid recipients about the estate recovery program during their initial application for Medicaid eligibility. Initial is the operative word. It does not mean after an individual has been put into Medicaid. Since healthcare.gov is the initial point of contact for applicants who reside in one of the 36 states using the federal exchange, there is no legitimate excuse for nondisclosure of estate recovery. Healthcare.gov is where the buck stops. The application should contain notification of estate recovery. The same is true for state-based exchanges that omitted this disclosure on their Obamacare applications.

Like terms of a contract, laws are supposed to be known. In Western civilization people are not supposed to be accountable to secret laws or to secret clauses in contracts that they sign. Clearly, if Western legal practice holds, estate recovery is impermissible due to the lack of notice. Only the corrupt architects of Obamacare believe that it is fair to confiscate the assets of an individual or a family without notification that the health care they receive can be charged to their estate.

Liens

Some state-based exchanges requested permission from CMS to add information to their application and chose to include disclosure of estate recovery. The Massachusetts Health Connector application not only includes disclosure of estate recovery, but also goes above and beyond, notifying applicants of liens. “To the extent permitted by law, MassHealth (Medicaid) may place a lien against any real estate owned by eligible persons or in which eligible persons have a legal interest. If MassHealth puts a lien against that property and it is sold, money from the sale of that property may be used to repay MassHealth for medical services provided.”

There are pre-death liens and post-death liens, and whether or not placement of a lien is disclosed on an Obamacare application, this practice is permitted in all states. For more on liens, you should consult an attorney–if you can afford one–or seek information online. It’s not pretty.

Renewal Of Coverage and Auto-enrollment

Note that Obamacare applications contain a section titled Renewal of Coverage in Future Years. An applicant can agree to allow an exchange to use income data, including information from tax returns to automatically renew eligibility for 1, 2, 3, 4 or 5 years, or applicants can check “Do not use information from tax returns to renew my coverage.” Exchanges have access to the federal data hub which keeps track of your income and other personal data. If you gave unfettered access to your data by choosing auto-renewal, they have all the information needed to determine whether you are still eligible for your subsidized policy or should be moved into Medicaid.

The letter sent to CMS in June 2013 also asked about estate recovery disclosure in cases where coverage is auto-renewed during the annual redetermination process, when people are shifted from a subsidized plan to Medicaid due to a decrease in income or other change in circumstance, and when people are auto-enrolled on the presumption that they are eligible according to a database such as SNAP (food stamps) or by a hospital or health care center. A similar letter was sent to the Massachusetts Office of Medicaid.

The federal procedural rules on estate recovery say the state should notify Medicaid recipients about the estate recovery program during the annual redetermination process, but according to the Massachusetts Office of Medicaid, you don’t need to be informed about estate recovery during the redetermination process because you presumably read about this on the original application you filled out and submitted.

If you submitted an application that did not disclose estate recovery, it cannot be presumed that you are aware of estate recovery, because notification was not on the application. Thus, the redetermination procedure is one more example of the failure to disclose.

If you are bumped into Medicaid from a subsidized plan due to a change in your circumstances, the Massachusetts Office of Medicaid believes that you don’t need to be informed about estate recovery because you presumably read about this however many years ago when you filled out the original application. You will simply be sent a notice that you are now in Medicaid, and the notice will refer you to the Medicaid Member Booklet for information on the rules. If you obtain and read the booklet, you can learn that you may be subject to estate recovery. But don’t expect to receive a Medicaid Member Booklet with your notice, because “It would be cost prohibitive to include a Member Booklet with every notice. Instead, every notice includes information on how to contact Customer Service with any questions, including to request a copy of the Member Booklet.”

Hope you know what questions to ask and that you do request a copy of the booklet immediately, pray that it arrives before you use any Medicaid services if you are age 55 to 64 and go over it with a fine tooth comb. If you don’t want to be in Medicaid, you can contact your state Medicaid agency to unenroll, but you’ll probably have to pay a penalty for being uninsured unless you can earn more money and get into a subsidized plan.

If you submitted an application that does not disclose estate recovery and you are bumped into Medicaid due to a change in your circumstances, you won’t know about this detrimental practice, but you can learn that your assets may be confiscated if you contact Customer Service and request a Member Booklet.

If you are auto-enrolled into Medicaid because you were presumed eligible through a SNAP (food stamp) database or by a hospital or health care center, you may still need to fill out a full application which may or may not disclose estate recovery.

Now let’s look at how the federal exchange at healthcare.gov will handle these situations.

The federal exchange will not be renewing coverage for Medicaid recipients. Your state Medicaid agency will handle your annual Medicaid eligibility redetermination (renewal). CMS responded to the citizen’s inquiry as follows: “State Medicaid agencies are developing their own renewal forms which may include a notice regarding estate recovery. CMS is in the process of finalizing a model renewal form to assist states, and we appreciate that you highlighted this requirement.”

Why did CMS need to be reminded about notification of estate recovery when the federal procedural rules that CMS is supposed to implement specify that notification is required?

You may receive a renewal form if your state Medicaid agency doesn’t employ the same “streamlined Obamacare procedures” that Massachusetts is using or if you did not choose auto-renewal. Your state Medicaid agency might come up with its own procedure for redetermination regardless of which option you checked on your original application. In any case, the renewal form might not include disclosure of estate recovery although your state Medicaid agency is familiar with the estate recovery notification requirement outlined in the federal procedural rules.

According to CMS, if you are bumped into Medicaid due to a change in your circumstances, your state Medicaid agency may notify you that you are now in Medicaid and “may include Medicaid-specific information as appropriate.”

If the state Medicaid agency sends a notice that you have been bumped into Medicaid, you might also receive Medicaid-specific information–or you might not. The notice will refer you to a pamphlet and provide you with a website address so you can learn that your heirs can be dispossessed in exchange for your being provided with minimal medical care.

If you are auto-enrolled because you were presumed eligible through a SNAP (food stamp) database or by a hospital or health care center, your state Medicaid agency will most likely send you a full application which might or might not disclose estate recovery.

Oregon fast-tracked residents into Medicaid in October 2013 by sending approximately 240,000 letters to those on food stamps. The Oregon Health Authority already had people’s information on file since they were participants in an income-based state program, and, thus, presumed eligible for Medicaid. The letter explained that all they had to do was let the Oregon Health Authority know they wanted to be enrolled in Medicaid by checking the “I-am-interested” box, provide some basic information on the enclosed one-page form and return it to the Authority in the enclosed stamped and addressed envelope. The Oregon Health Authority then worked on enrolling the 75,000 respondents and proceeded to send 177,000 reminder notices.

State Policy Changes

Oregon and Washington disclosed estate recovery on their applications and experienced low sign-ups. People are reluctant to accept having their families dispossessed of what little they have. Officials in both states said that state policy would be changed in order to apply estate recovery only to Medicaid patients in long-term care, and Cover Oregon (the state exchange) decided to remove estate recovery disclosure from its application in order to avoid alarming applicants. The Seattle Times reported that Washington’s Health Care Authority has filed an emergency rule to amend Medicaid’s estate recovery policy.

Privacy Violations

There is no pretending that your information is private or that Obamacare is concerned with protecting your privacy. California’s state exchange, Covered California, provided insurance agents with names and contact information for tens of thousands of people who either logged onto Covered California’s website to check out plans or who had partially filled out an application but did not finish, and did not ask to be contacted. Exectutive Director, Peter Lee, excused this breach of privacy on the grounds that the exchange’s legal counsel approved it and the state wanted to offer more assistance to Californians.

The privacy statement in the application of Colorado’s exchange, Connect for Health Colorado, states: “You release Connect for Health Colorado and the Department of Health Care Policy and Financing from all liability for sharing this information with other agencies.” Some of the sharing agencies include the United States Customs and Immigration Services, Department of Homeland Security and financial institutions (banks, savings and loans, credit unions, etc.).

In the event that your data has been compromised, states must notify you, but the federal government is not required to do the same, and is, therefore, more likely to hide its security flaws and privacy breaches. According to the Washington Post, administration officials knew when the federal site was launched that the privacy of user data would be at risk. An internal Department of Health and Human Services (HHS) memo warned that sufficient testing of data security had not been performed.

Subsidized Premiums And Cost-sharing Reductions Are Also Subject To Recovery

CMS and many of the state-based exchanges also left out notification that the tax credit you receive for a subsidized plan and the reduction in cost-sharing and deductibles are advance loans and could leave you with an unexpected debt to the IRS. Most likely, the lack of this disclosure as well as estate recovery was intentional so people would not be deterred from signing up for health insurance. Thus, CMS and other exchanges unilaterally surrendered your right to know important rules that can adversely impact you and your family. Non-disclosure of all rules, rights and responsibilities is not a standard and acceptable business practice and could be deemed fraudulent in a court of law.

Connect for Health Colorado states your acceptance in the fine print on its application: “I understand that if I am eligible for the Advance Premium Tax Credit (APTC) and/or Reduced Co-pays and Deductibles these payments will be made directly to my selected insurance carrier(s). Acceptance of (APTC) and/or Reduced Co-pays and Deductibles may impact my coverage year tax liability. I will be given the option to apply all, some, or none of any APTC amount I may be eligible for to my monthly premium.”

Do you know what this means? It is notification that you may have to pay back part or all of your Obamacare health premium subsidy and reduced co-pays and deductibles if your income rises during the year.

The Advance Premium Tax Credit is the subsidized part of your Obamacare premium. The subsidy and cost-sharing reductions are based on an estimate of your total income for the year in which you apply for insurance at an exchange. If your income at the end of the year is higher than the estimate, you may have a tax liability for part or all of these two items because they were based on a lower income. To avoid this risk, you can choose to negotiate a smaller subsidy and pay more of your premium to reduce your exposure to possible tax liability for overpayment of the subsidy. Alternatively, you can refuse the tax credit, pay full freight and collect your tax credit based on your actual year-end income when you file your federal tax return. You can’t negotiate cost-sharing reductions, but, you can opt not to apply for these unless you don’t mind shouldering a possible payback.

Medicaid Managed Care Plans

Some states use private insurers to manage health care for their Medicaid population through Medicaid Managed Care Plans, and the Obamacare expansion of Medicaid is a huge money-maker for these private insurers as well as a huge cost booster for U.S. health care. For giants UnitedHealthcare and WellPoint, as well as for smaller publicly-traded companies such as Molina Healthcare, a Fortune 500, multi-state health care organization, an expanded customer base brings revenue growth. Medicaid Managed Care Plans are hoping to enroll the majority of the expanded Medicaid population.

“This is several hundreds of billions of dollars of new market opportunity for these plans over the next couple of years,” says Jason Gurda, managing director of healthcare with investment bank Leerink Swann in New York.”

Many states are choosing to move all or portions of their Medicaid populations to managed care plans. Thirty-five are expected to make changes to their managed care programs in 2014, up from 28 in 2013 and 20 in 2012. A Managed Care Plan is a system of health insurance which includes a network of contracted providers that are paid a fixed amount to provide health benefits to a defined population. Needless to say, this model relies on restriction and denial of care putting Medicaid patients at risk.

A Medicaid Managed Care Plan adds more charges subject to estate recovery for those who are tossed into Medicaid. The Medicaid Manual says that when an individual age 55 and older is enrolled either voluntarily or mandatorily in a managed care plan, the state must seek recovery from the individual’s estate for the premium payments. If the state plan recovers for all Medicaid services, the state must recover from the individual’s estate the total capitation rate for the period the beneficiary was enrolled in the managed care plan. If the state plan recovers for only some services covered under the state plan, the state must recover from the individual’s estate that portion of the capitation payment that is attributable to the recoverable services, based on the most appropriate actuarial analysis determined by the state.

The manual also states that when the individual enrolls or is enrolled in the managed care plan, the state must provide a separate notice to the individual that explains that the premium payments made to the managed care plan are included either in whole or in part in the claim against the estate.

States that use private insurers to manage their Medicaid population will most likely have capitation payments but might not have reinsurance or fee-for-service programs which can also be recovered from an estate. Therefore, it is prudent to find out what your state has and who is affected. Here are the fees that can be recovered from estates:

Capitation Payments–a fixed monthly fee paid by the state to the Medicaid Managed Care Plan for each month you are enrolled in one of these plans, regardless of whether or not you use any medical services. If you do seek care, capitation payments can exceed the actual costs of services provided during the month.

According to the Massachusetts EOHHS Privacy Office: The estimated average capitation payment for October 1, 2013 through December 31, 2013 was $449.59 per month– an average annual total of $5,395.08. In other words, a person from age 55 through, let’s say, 62, accumulates $43,160.64 on his or her tally against assets including the home. There goes a chunk of your estate even if you didn’t use any medical care.

Reinsurance Payments–An amount reimbursed to program contractors for certain contract service costs incurred by a Medicaid patient that are beyond a contractual dollar threshold. These payments are in addition to the monthly capitation payment.

Fee-for-Service Payments–A direct payment of some or all of a Medicaid member’s medical bills not covered by other available insurance.

According to the Massachusetts Office of Medicaid, with certain exceptions, persons who are eligible for the Obamacare Medicaid expansion (age 21 to 64) must enroll in one of the state’s Medicaid Managed Care Plans.

The hard sell is on for states to privatize Medicaid, and many who are forced into Medicaid by Obamacare will also be forced into managed care plans as is the case in Massachusetts. This represents yet another noose around the necks of low-income and poor people since the three payments described above are recoverable from estates.

Once the limited estates of poor and low-income Americans have been taken to reimburse Medicaid, the U.S. will be left with a permanently poorer and more desperate population and will be faced with higher Medicaid costs as there will no longer be any private property to confiscate.

Pursuant to the Deficit Reduction Act of 2005 (DRA) and clarified in the Tax Relief and Health Care Act of 2006, states were given greater authority to impose and increase premium and cost-sharing charges on certain Medicaid enrollees, but despite these charges their estates are still subject to recovery. Under Obamacare, the government has a right to recover reimbursement from estates of those with lower incomes who are enrolled in Medicaid. Yet, individuals with higher incomes who qualify for a subsidized plan are also paying premiums subsidized by the government but are not subject to estate recovery.

Is it fair to impose estate recovery on Medicaid enrollees but not on other subsidy recipients? Is it fair if recovery adheres to the basic requirements in federal statute, but, thereafter, is based on state policy which differs from state to state and, thus, is not applied equally across the nation to all Medicaid enrollees at age 55 and up? Is targeting a specific age group fair? Or legal?

Equal protection is in the Constitution, but ever since the Supreme Court surrendered in the 1930s to President Franklin D. Roosevelt’s New Deal legislation, equal protection has been curtailed in the economic arena. The Supreme Court, unwilling to face down a President asserting previously unknown executive power, accepted the violation of the 14th Amendment in economic legislation in order to avoid being packed with FDR yes-men.

Obamacare was not written for the benefit of the poor and uninsured. It was written for the profits of the insurance companies giving them millions of new customers subsidized by U.S. taxpayers. The business of America is business. Private insurance company CEOs receive multi-million dollar pay packages, while under Obamacare low-income earners and the poor have to give up their homes and other assets in order to receive medical care.
